Privacy Policy

This policy describes what the Wake swim app, its servers and this website do today. Where something is not built yet, we say so. We never sell your personal information.
The Short Version
- Videos you upload, linked to your account, and the analysis we derive from them are used to train Wake's models. There is currently no opt-out. An "Anonymize my data" setting is coming soon; it is not yet available.
- Google Gemini analyzes your swim videos, meal photos and conversations with Sammy.
- To delete your account or get a copy of your data, email support@wakeai.app. Deletion finishes after 30 days.
- The app does not verify age today. Wake is intended for people 13 and older.
- TestFlight beta builds of the app use our staging servers. Beta videos are not yet deleted automatically.
- Wake has no paid features.
1. Who We Are and What This Covers
Wake AI LLC ("Wake", "we", "us") makes the Wake swim app for iPhone, currently offered as a free beta through Apple's TestFlight, and runs this website, wakeai.app. This policy covers the app, the servers it talks to, and this website.
2. Information We Collect
Account and Profile
- Your email address, name and username.
- If you sign in with Google: your Google account's name, email address and profile photo.
- If you choose to add them: a profile photo, height, weight, fitness background, competition history, a short bio and a location you type in.
- Your password is handled by Google's Firebase Authentication. Wake never receives or stores it.
Swim Videos
When you upload a swim video, we store the video and the details you attach to it (exercise details, tags, goals, notes and whether it is public). From each video we derive:
- 2D body pose points for each frame
- a 3D body mesh
- a numeric summary of the clip that Wake's models use
- a written stroke analysis from Google Gemini (the "Language Model Intelligence" tab in the app)
Full-Body Photo (Optional)
If you add a full-body photo, we build a 3D body model from it. If you set a weight goal, Google Gemini can create a projected image of how that change might look.
Meal Photos
Meal and nutrition-label photos are sent to Google Gemini to estimate foods and macronutrients. We store the estimates, not the photo.
Health, Workout and Wearable Data
- Apple Health (read only): steps, heart rate, active energy, sleep, body mass, body fat percentage, body temperature, VO2 max and workouts. Wake does not write to Apple Health.
- Garmin (if you connect it): daily summaries, heart rate, heart rate variability, sleep, Body Battery and activities, including swim laps, strokes and SWOLF.
- Oura (coming soon; it cannot be connected yet): once connected, it will send sleep, daily readiness and workouts.
- Workouts, meals, mood check-ins and other entries you add yourself.
From your Garmin swim laps we work out your pace per 100 meters for each swim.
Goals, Plans and Groups
Your goals and progress, your monthly plan (including drills you add with "Add to my month"), and the groups and medical practices you join.
Sammy
Messages you type or dictate to Sammy and Sammy's replies, including audio of Sammy's spoken replies. Dictation is turned into text by Apple's speech recognition, on your iPhone when your device supports it. If you set a goal by voice, that recording is sent to Google Gemini.
Diagnostic Data
The app and our servers record diagnostic data, such as the screens and actions used, errors, timings, device model and iOS version. It goes to Wake's own telemetry system, not to an outside analytics company. Our server logs record which account made each request. We use no advertising identifiers, no third-party analytics and no advertising SDKs.
What We Do Not Collect
The app does not ask for your location or your contacts, and we do not collect GPS history from your devices.
3. Biometric and Body Data
Biometric data notice: the pose points and 3D body mesh we derive from your videos, and the 3D body model from a full-body photo, may be biometric identifiers under laws such as the Illinois Biometric Information Privacy Act (BIPA).
We use this data to analyze your swimming, to show the pose overlay and 3D mesh in the app, and to train Wake's models as described in Section 4. It is kept as described in Section 7 and deleted as described in Section 8.
4. How We Use Your Information
- To run the app: analyze your videos and meals, show your workouts, sleep and recovery, track goals, build your plan, and let Sammy answer using your data.
- To train Wake's models: videos you upload, linked to your account, and the analysis we derive from them are used to train Wake's models. There is currently no opt-out. An "Anonymize my data" setting, which will let you have your videos used for training without your account ID, is coming soon; it is not yet available. Public and private videos are treated the same way.
- To tell you things: for example a "Your swim is ready" notice in the app when a video's analysis finishes, and replies to your support emails.
- To keep Wake working and secure: find and fix errors and prevent abuse.
5. Who Receives Your Data
We do not sell your personal information, including biometric and health data, and we do not share it for advertising. These parties receive data so Wake can work:
- Google Cloud: hosts our servers, databases and file storage, in the United States (Iowa).
- Google Firebase Authentication: handles sign-in. It receives your email address and password, or your Google sign-in.
- Google Gemini: receives whole swim videos, meal photos, your full-body photo if you ask for a projection, voice recordings for goals, your conversations with Sammy, and the health and recovery data Sammy uses to answer. We delete the videos we upload to Gemini after each analysis. Google handles this data under its Gemini API terms.
- Garmin: when you connect it, you sign in on Garmin's site and Garmin sends us the data listed in Section 2. Oura will work the same way once it can be connected.
- Apple Health: the app reads the types listed in Section 2 on your iPhone.
- DocuSign: receives your name and email address when you sign a HIPAA authorization.
- A medical practice you join: its providers can see your health data in Wake if you have a treatment relationship with them.
- Other Wake users: only what you make public. Public goals show their title, tags, and your name and username. Public videos appear in the app's Follow feed.
- Cloudflare: delivers this website. It does not handle app data.
- FormSubmit: delivers messages from this website's contact form to our support email.
- Apple: distributes the beta through TestFlight. Wake has no in-app purchases.
- Legal requirements and business transfers: we may disclose data when the law requires it or to protect safety. If Wake is merged, acquired or sold, your data may be transferred; we will notify you by email before it becomes subject to a different privacy policy.
Apple Health Data
- We use Apple Health data only to provide Wake's health and fitness features, including Sammy's answers.
- We do not use it for advertising or marketing, sell it, or share it with anyone for their advertising or marketing.
- You can turn off Apple Health access in your iPhone's Settings. That stops new reads but does not delete what was already synced; to delete it, email support@wakeai.app.
California Shine the Light (Civil Code § 1798.83)
We do not disclose personal information to third parties for their direct marketing purposes.
6. Security
- Data is encrypted in transit with TLS.
- Data is encrypted at rest with Google Cloud's default AES-256 encryption.
- The app pins our server certificates, so it refuses to talk to a server that presents a certificate we did not expect.
- Our staging and production servers run in the same Google Cloud project and share one database cluster.

8. Your Choices and Rights
- Delete your account and data: email support@wakeai.app from the address on your account. Deletion finishes 30 days after your request, which gives you time to change your mind. It covers your account, profile, videos and the files derived from them, full-body photo and 3D body model, health and wearable data, goals, plans and Sammy conversations.
- What deletion keeps: records of consents you signed (such as HIPAA authorizations and medical-practice consents), and audit logs with your identity removed.
- What deletion does not yet reach: your meal-analysis results, and copies of your videos and analysis already in Wake's model-training sets. Nothing can remove what a trained model has already learned.
- Get a copy of your data: email support@wakeai.app. The app has no export button today.
- Correct your data: edit your profile in the app, or email us.
- Limit what you share: goals and videos are private unless you make them public. You can remove Garmin in the app, or revoke Wake's access on Garmin's website, and turn off Apple Health access in your iPhone's Settings.
We respond to requests within 45 days. We will not treat you differently for exercising these rights.
9. Consents We Ask For
- Sign-up: email sign-up requires checking "I agree to the Terms of Service and Privacy Policy". Google sign-in shows the notice "By signing in, you agree to our Terms and Privacy Policy."
- iPhone permissions: iOS asks your permission before Wake can use Apple Health, the camera, your photo library, the microphone, speech recognition and notifications.
- Garmin: asks your permission on its own sign-in page before sharing data with Wake. Oura will do the same once it can be connected.
- HIPAA authorization: we ask you to sign a HIPAA authorization through DocuSign before you join a group or a medical practice.
There is no separate consent screen for biometric data or for model training today. Your agreement to this policy at sign-up is the consent we rely on for both.
10. TestFlight Beta Builds
Beta builds of the app connect to our staging servers, not our production servers. The same protections apply, except that beta videos are not yet deleted automatically (see Section 7).
11. Illinois Residents (BIPA)
- What we collect: pose points and 3D body meshes derived from your videos, and a 3D body model if you add a full-body photo.
- Why: to analyze your swimming, show it back to you, and train Wake's models (Section 4).
- How long: as set out in Section 7. Data derived from production videos is deleted one year after upload; data from beta builds is kept until you ask us to delete it.
- No sale or profit: we do not sell, lease, trade or otherwise profit from your biometric data.
- Disclosure: only to the service providers in Section 5 (Google Cloud stores it; Google Gemini receives the videos it comes from) or as the law requires.
- Consent and revocation: see Section 9. To revoke consent, email support@wakeai.app; we will delete your account and data as described in Section 8.
12. Washington Residents (My Health My Data Act)
- Consumer health data we collect: body data from videos and photos, workouts and swim data, meal estimates, sleep, heart rate, recovery and readiness data, mood check-ins, and goals.
- Why: to provide Wake's features and to train Wake's models (Section 4).
- Who receives it: the parties in Section 5.
- No sale: we do not sell consumer health data.
- Your rights: to confirm whether we collect or share your consumer health data, to access it, to delete it, and to withdraw consent. Email support@wakeai.app with the subject "MHMDA Request". If we deny a request, you may appeal with the subject "MHMDA Appeal".
13. California Residents (CCPA/CPRA) and Other States
California residents may ask to know, delete and correct their personal information. We collect sensitive personal information (biometric and health data) and use it to provide Wake and to train Wake's models. We do not sell or share personal information for cross-context behavioral advertising. You may use an authorized agent.

Residents of Colorado, Connecticut, Virginia and other states with privacy laws have similar rights to access, correct, delete and port their data. For any of these rights, email support@wakeai.app.
14. Health Breach Notification
If a breach involves your health or biometric data, we will email you within 60 days of discovering it, as the FTC Health Breach Notification Rule (16 CFR Part 318) requires, and notify the FTC where required. The notice will say what happened, what data was involved, what we are doing, what you can do, and how to reach us.
15. This Website: Cookies and Similar Technologies
- If you sign in on this website, your Google sign-in is kept in your browser's local storage. Your answer to the cookie banner, and a referral code if you arrived through a referral link, are kept there too. None of these are sent to us except the sign-in, when you use a feature that needs it.
- We run no analytics and no advertising on this website. Because nothing tracks you, there is nothing for a Do Not Track signal to turn off.
- Google (for its sign-in button) and Cloudflare (which delivers the site) may set their own cookies.
- Pages load fonts and code from Google Fonts, cdnjs and jsDelivr, which see your IP address. The Vision page embeds a YouTube video in privacy-enhanced mode.
- Messages you send through the contact form go to our support email through FormSubmit. Messages you send through the "Request a Feature" chat, with the email address of the Google account you signed in with, go to Wake's own feature-request service, which uses Google Gemini to reply and records each request in Wake's private issue tracker on GitHub.
16. Children
The app does not verify age today. Wake is intended for people 13 and older, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, email support@wakeai.app and we will delete it as described in Section 8.
17. Where Data Is Stored
We store your data in the United States, on Google Cloud in Iowa. Service providers such as Google Gemini, Garmin and DocuSign may process the data they receive in other countries.
18. Changes to This Policy
When we change this policy we update the date at the top. For material changes to how we handle health or biometric data, we will email you at least 30 days before they take effect.
